The electronic webshop of BV Juwelen A. Bouverne, with registered office at Kortedagsteeg 39, 9000 Ghent and company number BE 0423124886, hereinafter referred to as ‘Juwelen Bouverne’, offers its customers the opportunity to purchase the products from its webshop online.
These General Terms and Conditions (‘Conditions’) apply to every order placed by a visitor to this e-commerce website (‘Customer’).
When placing an order via Jewellery Bouverne's online shop, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions to the exclusion of all other conditions. Additional conditions of the Customer are excluded, except when previously, in writing and expressly accepted by Juwelen Bouverne.
The prices of the products are the prices stated on the website at the time the Customer places an order.
All prices include VAT at the applicable current rate in the country of residence of the Customer.
All prices of the products exclude delivery costs. The delivery costs are available to the Customer and are calculated at the time the order is placed in accordance with article 4. The delivery costs will depend on the address and country to which the products are to be shipped.
Before placing an order, the total price, including all costs and taxes, will be available to the Customer and will be stated.
If a product is not correctly priced on the Website, Juwelen Bouverne will contact the Customer in writing as soon as Juwelen Bouverne becomes aware of the incorrect price. The Customer has the option to continue purchasing the products or to cancel the order. The order will only be processed after Juwelen Bouverne has received the Customer's instructions within 8 days from the moment Juwelen Bouverne has notified the Customer. If Juwelen Bouverne fails to contact the Customer using the contact details provided by the Customer during the ordering process, or if Juwelen Bouverne does not receive a response from the Customer within the period stated above, Juwelen Bouverne will treat the order as cancelled and will notify the Customer thereof in writing.
The products are exclusively intended for normal private use. The Customer undertakes not to resell the products for speculative purposes within a period of two years after the purchase without prior written permission from Juwelen Bouverne.
Obvious mistakes or errors in the offer do not bind Juwelen Bouverne. Juwelen Bouverne is only bound to a means obligation with regard to the correctness and completeness of the information provided.

The offer is always valid while stocks last and can be adjusted or withdrawn at any time by Juwelen Bouverne. Juwelen Bouverne cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
An order can only be placed via www.bouverne.be.
The purchase is concluded the moment the customer receives a confirmation e-mail from Juwelen Bouverne.
If the customer pays by bank transfer, Jewellery Bouverne will start processing the order from the moment full payment is received. If Jewellery Bouverne does not receive full payment within 3 days of receiving the order, Jewellery Bouverne is entitled to automatically cancel the order
Jewellery Bouverne is entitled to refuse an order (in writing or by e-mail), following a serious default by the customer in relation to the order or any other order or agreement involving the customer.
After the payment has been completed and the money has been received on the account, the purchased product will be packed and shipped via a carrier approved by Jewellery Bouverne and meeting the standards for safety and insurance.
The Customer is responsible for entering a correct address. Jewellery Bouverne is not liable for incorrect delivery. The customer bears additional shipping costs if the parcel has to be resent due to the entry of an incorrect address. The shipment will be completed only after payment of the costs.
If the customer has any questions about the shipment, the customer can always contact the Jewellery Bouverne customer service mentioned in article 9.
Jewellery Bouverne ensures that the products are carefully packed. However, due to force majeure, it is possible that the parcel may be damaged. Any visible damage and/or qualitative defect of an article or any other shortcoming in the delivery must be reported within 24 hours. Jewellery Bouverne cannot be held liable for possible damage.
The risk due to loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods.
The delivered products remain the exclusive property of Juwelen Bouverne until full payment by the Customer.
The customer undertakes, if necessary, to draw the attention of third parties to Juwelen Bouverne's retention of title, e.g. to anyone who might come to seize products which have not yet been paid for in full.
The Customer has the right to cancel the order without giving a reason and without charge before shipment of the order.
The Customer may cancel the order by sending an e-mail to info@bouverne.eu.
After cancelling the order, the Customer will receive confirmation of the cancellation by e-mail and Jewellery Bouverne will refund the amounts already paid on the credit or debit card the Customer used to pay.
After receiving confirmation that the products have left Jewellery Bouverne, the Customer cannot cancel the order.
If it was not possible to cancel the order, the products will be delivered and the Customer can return the Product according to the procedure described in article 8.
The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving any reason.
The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, physically takes possession of the goods.
In order to exercise the right of withdrawal, the Customer must inform Juwelen Bouverne of his decision to withdraw from the agreement using the attached model form (appendix) or in another unambiguous manner (e.g. in writing by post or e-mail).
This communication must contain the following:

If you have received an incorrect or damaged item, please also inform us of this.
In order to comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return the goods without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to withdraw from the agreement to Juwelen Bouverne.
The direct costs of returning the goods are borne by the Customer, who must return them either personally to the store or via a carrier approved by Bouverne.
Only products that are in the original and undamaged packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.
Juwelen Bouverne is not obliged to take back used, soiled, damaged or incomplete products if they have not been used solely to determine the nature, characteristics and functioning.
Juwelen Bouverne reserves the right to take back the goods in the above cases, provided that a reduction in value (which is the result of unauthorized use) is charged upon repayment.
If the Customer revokes the agreement, Juwelen Bouverne will refund all payments received from the Customer up to that point, excluding delivery costs (and any reduction in value due to unauthorized use) to the Customer within a reasonable period and a maximum of 14 calendar days after receipt by Juwelen Bouverne of the returned products.
The Customer cannot exercise the right of withdrawal for the delivery of goods manufactured according to the Customer's specifications, or which are clearly intended for a specific person.
The Customer is entitled to a two-year legal warranty. The legal warranty covers any defect or lack of conformity of the products that manifests itself within a period of two years from the date of delivery of the products.
The Customer must inform Juwelen Bouverne of a defective article within a reasonable period after the defect is known or could reasonably have been known by the Customer and no later than two months after the discovery of the defect.
After return of the defective article, Juwelen Bouverne will, at the Customer's discretion, send the Customer a new article or repair the article and bear all costs related to the exchange/repair of the Products. The article can only be replaced and delivered insofar as it is still available/in stock at Juwelen Bouverne's suppliers. If repair or replacement is not possible or cannot be carried out within a reasonable period, the Customer has the right to terminate the agreement and Juwelen Bouverne will refund the price in accordance with Article 8.
Some products have a manufacturer's warranty. For details on the applicable conditions, please refer to the manufacturer's warranty provided with the products. If the Customer is a consumer, the statutory warranty period of two years is supplemented by a manufacturer's warranty.
In the context of the purchase of a Rolex watch, Juwelen Bouverne will immediately activate the Rolex warranty card by using the GCA application.

Any complaints can be sent to this address and Juwelen Bouverne will handle this complaint within a reasonable period of time.

Without prejudice to the exercise of other rights available to Juwelen Bouverne, in the event of non-payment or late payment, the Customer shall owe, by operation of law and without notice, an interest of 10% per year on the unpaid amount from the date of default. In addition, the Customer shall owe, by operation of law and without notice, a fixed compensation of 10% on the amount in question, with a minimum of 25 euros per invoice.
Without prejudice to the foregoing, Juwelen Bouverne reserves the right to take back products that have not been (fully) paid for.
The controller, Juwelen Bouverne, respects the Belgian law of 8 December 1992 regarding the protection of privacy in the processing of personal data.
The personal data provided by the Customer will only be used for the following purposes: the execution of the concluded agreement, the processing of the order,), the sending of newsletters, advertising and/or marketing purposes.
In the context of the purchase of a Rolex watch, the personal data can also be used to activate the warranty card or to inform the manufacturer of a return by the Customer.
The Customer has a legal right to inspect and possibly correct his/her personal data. To this end, the Customer will receive an e-mail with login details. Your registration allows you to adjust your personal data and to maintain an overview of your purchase history. The Customer is responsible for keeping his/her login details confidential and the use of his/her password. The password is stored encrypted, so Juwelen Bouverne does not have access to the password.
In case of use of data for direct marketing: You can object to the use of your data for direct marketing free of charge. To do this, you can always contact Juwelen Bouverne's customer service.
Juwelen Bouverne treats the Customer's data as confidential information and will not pass it on, rent it out or sell it to third parties.

If any provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.
Failure at any time by Juwelen Bouverne to enforce any of the rights listed in these Terms, or to exercise any right thereof, will never be considered a waiver of such provision and will never affect the validity of these rights.
These Terms are supplemented by other conditions to which explicit reference is made, and the general terms and conditions of sale of Juwelen Bouverne. In the event of any conflict, these Terms prevail.
The Customer accepts that electronic communications and backups can serve as evidence.
Belgian law applies.
In the event of any disputes, the courts of Ghent shall have exclusive jurisdiction.
